Abstract

This study aims to analyze the practice of hoarding (ihtikar) in modern markets from the perspective of Islamic economic law and to assess its alignment with the principles of maqasid al-shariah and distributive justice. Hoarding is a significant issue in contemporary economic systems as it causes artificial scarcity, price inflation, and unequal access to essential goods. This research employs a qualitative approach using library research methods, drawing on classical Islamic jurisprudence (fiqh al-mu’amalah), the objectives of Islamic law, prophetic traditions prohibiting ihtikar, and contemporary studies on distribution systems and market regulation. The findings indicate that Islamic law strictly prohibits ihtikar due to its violation of the protection of wealth (hifz al-mal) and life (hifz al-nafs). Furthermore, the concept of hisbah—an Islamic institution of market supervision—remains highly relevant for modern market contexts, as it represents a form of state intervention to ensure price stability and fair distribution. The originality of this study lies in its integration of normative-historical analysis with current economic practices, offering valuable insights into how Islamic ethical and legal frameworks can be incorporated into modern policy-making. The research recommends the revitalization of sharia-based supervisory systems and the strengthening of state and societal roles in combating hoarding practices to achieve long-term economic justice.
